Disclosure issues, hiding of evidence by Entain Throughout the proceedings, from a very early stage, there have been numerous attempts by the Respondent to not disclose easily available evidence. During the final hearing this became clear and several important documents had to be disclosed. This clearly intentional hiding of evidence has made it significantly more difficult for me to prepare my case. The Chairman has failed completely to address this point, although it was mentioned by me in most, if not all, preliminary hearings. This made my access to Justice significantly more difficult. Page 1613 E – 1614 D: after a number of verbal complaints about being bullied, I started to send emails with detailed complaints about being bullied to my management, whom involved HR. The members of Camp 2, the bullies, were called in for several individual meetings to talk about their behaviour and with the threat that “further measures will be taken” if their behaviour towards me continues. Things got a bit better for a short time and HR communicated to my management that “a note” had been added to the Camp 2 bullies' HR file. These “notes” have never been disclosed by the Respondent and, interestingly enough, the Chairman has never ordered their disclosure although these notes obviously could contain some very incriminating evidence against the Respondent. Page 1830 B – 1832 B: The point arises that Dennis Dorland and Stef van Veen had been offered medical help by the Respondent for their mental health issues and that I was not offered such help. This is victimisation and a breach of an employer's Duty of Care. At the time of filing my Claim Form, I was not aware of this. Page 2003 F – 2004 B: I point out that Roni Maman never disclosed what data he got from HR for his bullying grievance investigation. This was without doubt very significant evidence on which Mr Maman based his wrong conclusion that I had never been bullied. The Chairman does not order the disclosure of these emails. Page 2731 A – D: the files Roni Maman was given by HR for his grievance investigation are finally disclosed via email the evening before Mr Maman's cross-examination and are added to the bundle of evidence. This made that I could not confront Susana Martin and Danielle Wood during their cross-examination with the content, which was highly misleading for Mr Maman. Page 2269 G – 2270 D: Susana Martin states that Jose Luis Aznar got a meeting with her with minutes being taken by Samira Mouhayar. This was supposedly the same meeting held with me which I called the “trap meeting”. These minutes were not disclosed, neither does the Chairman intervene to have them disclosed. In page 2364 A – H: Jose Luis Aznar talks about this meeting with Susana Martin with Samira Mouhayar taking minutes. Those minutes were never disclosed. It would have been interesting to compare the meeting minutes to the minutes of my own meeting, which led to the grievance investigation. Page 2274 B – F: Susana Martin states that she did a daily feedback to Samira for her PIP, in which she likely mentioned me. Nothing of this has been disclosed and the Chairman thinks this is fine. Page 2300 F – 2301 H: it is found out that the minutes of a meeting between Susana Martin and Roni Maman were not disclosed, although the minutes should be found easily as they should have been part of the grievance investigation file. This time the Chairman asks Mr Martinez to disclose the minutes. It is pretty clear that this easily retrievable document was not disclosed on purpose. Page 2372 G – 2373 C: Danielle Wood put a note on Camp 2's HR files after she thinks the early bullying was stopped. Those notes were never disclosed although I requested them. I believe it is likely that some conclusion was in those notes that Camp 2 were bullies, and disclosure was therefore not desirable. Page 2463 C – E: a document was disclosed by Yousri Amrani on the Friday before the ten-day Tribunal hearing started on Monday morning. Page 2698 A – 2699 H: Further disclosure by Danielle Wood; the documents emailed to Roni Maman for his grievance investigation. These documents proved that there was no fair grievance investigation. Page 2513 B – 2514 C: I complain to the Chairman about the very late disclosure of documents. Page 2518 A – 2519 H: The Chairman expresses his surprise about the non-disclosure of a document. |
