Check for yourself if I was bullied and unfairly dismissed while I worked at Entain. By reading my detailed witness statement, which includes emails and minutes of meetings, you can ask yourself the question if the behaviour I complained about, was causing me feelings of alarm, distress, humiliation or intimidation. In other words: was I being bullied by some of my direct colleagues and later by my team leader too? When I fell ill with stress related anxiety and depression, caused by the stress at work, was this not proof that the bullying was so frequent and ongoing over a long time, that the alarm, distress, humiliation and intimidation, although repeatedly reported to my managment and HR, were of a very serious nature? If this was the case, why did Entain's management and HR fail to stop the bullying? Ask yourself the question too if others in my team were being bullied by the same people. How does one explain that Entain lost 100% of team members in my team over a period of at least 2 years while in other teams the turnover was low? Everyone who has asked himself these questions, and read my witness statement, came to the conclusion that it is a clear case of bullying at work going on for a long time. This raises a very serious question: why did the Employment Tribunal NOT see bullying where everyone else sees it? After I had finally succumbed to stress related anxiety and depression, I refused to return to my normal place of work. I feared that further exposure to the bullies would make my mental illness worse. I informed my management and HR repeatedly in writing about this risk but in the same time, I offered to return to work in another team and/or another department where I would not be exposed to the bullies. It is an employee's legal right to refuse to return to a dangerous place of work under Health and Safety laws, rules and regulations when he communicates this clearly to his employer. The question you have to ask yourself, while reading my witness statement, is if I did inform Entain that I felt that my workplace was dangerous and that a return would harm my mental health. If I did indeed do so, then my dismissal was, by law, automatically an unfair dismissal. Till to date, everyone who read my witness statement, concluded that I did inform Entain's management and HR many times about the dangers at my normal place of work.
