“Shadowing” meant that more experienced team members were checking the proposed answers to customer questions to make sure that no mistakes were made by trainees. They were supposed to give advice and correct errors. This was only done for the first few weeks, after that you got used to the different systems and you could work on your own. The experienced team members in those days were Camp 2 and Martijn van der Vechte. This set-up gave the “shadowers” a position of power or influence over the new starters, a position which could be abused to bully some or all of the new starters.
The interesting thing is that in their written witness statements, the Camp 2 members, Jose Luis Aznar and Yousri Amrani, and the company's Customer Service managers, Susana Martin and Samira Mouhayar, all state under oath that only Martijn van der Vechte did shadow the new starters, so they all state that Camp 2 did not do “shadowing” and Camp 2 was therefore not in a position to bully the new starters. During cross-examination, it became crystal clear that Camp 2 did indeed shadow the new starters, so all four (Camp 2 and management), lied in their written witness statements, which were based on interviews in the Hassans' offices. This complete misrepresentation shows the collusion between the witnesses and an attempt to rewrite history. All four were caught out lying under oath but the Chairman never mentions this in his Judgement.
Page 2132 A – G: Susana Martin states that Martijn van der Vechte was the only person allocated to do shadowing. She lied.
Page 1762 F – 1763 G: Dennis Dorland states that Camp 2 and Martijn van der Vechte were “shadowing” the new starters, which were himself, Stef van Veen and I.
Page 2075 B – 2076 A: Stef van Veen confirms that Martijn van der Vechte and Camp 2 did shadowing.
Page 2328 G – 2329 D: Jose Luis Aznar admits the he was shadowing me and the other new starters for a limited time while in his written witness statement he wrote that only Martijn van der Vechte was shadowing us. He then contradicts himself by stating that he continued shadowing me, even after I passed my probation, which is nonsensical as by then I was perfectly capable to work alone and did not need any input from colleagues anymore.
Page 2393 E – H: Yousri Amrani confirms that Martijn van der Vechte and Camp 2 did shadow the new starters, contrary to what he mentioned in his written witness statement.
I personally do not understand why the Respondent has made an attempt to rewrite history in a way that was so easily caught out. I understand even less why the Chairman completely ignored this evidence of collusion.
