Stefan Kalcher Cross-examination This witness, an IT specialist, was visibly uncomfortable and nervous during cross-examination. Mr Kalcher again and again tried to convince everyone that I did not qualify for the Business Analyst job I had applied for. He attempted to defend the indefensible and was not good at it, he was lying and trying to give a different meaning to many things. This witness' credibility was low and I felt that he had been put under pressure to lie. The importance of this witness is, that if I can prove that I could and should have gotten this job, my wages would have increased from £20,000 + 10% bonus to £45,000 + 20% bonus. My wages would have been tripled, which is very important for the calculation of the compensation I am owed by the Respondent. This witness was caught out and interestingly enough, shortly after the hearing, he left the company without other employment. Page 2656 A – F: Stefan Kalcher states that he had seen my CV and found it good enough to continue with the second stage of the application process, a video interview. Page 2658 D – G: Stefan Kalcher states that the video interview was good, so he decided to let me do the next stage of the application process, the technical test. Page 2659 A – E: Stefan Kalcher says that Business Analysts are easy to find. This is a lie, as the profile is rare and there are significantly more job offers than available candidates on the market. Page 2659 F – 2660 A: Stefan Kalcher states that there was some urgency to get the job filled. Page 2660 H – 2661 B: Stefan Kalcher states that he got three to five vacancies for Business Analysts per year. Page 2663 E – 2664 B: Stefan Kalcher states that for the logical question, there is no right or wrong answer to it. In page 2669 G – 2672 B: Stefan Kalcher tries to explain why my answer was “too basic”, while he answers in exactly the same way as I did. When I pointed this out, Mr Kalcher tried to beat around the bush about this subject. He then seems to state that I answered this question correctly, as it was the only question we had spoken about till then. Page 2664 G – 2669 A: Stefan Kalcher states that he informs candidates as soon as possible if they clearly failed the test, to prevent uncertainty. I point out the long duration of this application process for a position that required urgency. Mr Kalcher's strange excuse for failing the first question, was that he had expected internet research from a computer without an internet connection. Mr Kalcher was clearly trying to talk himself out of this. Page 2672 A – 2673 F: Stefan Kalcher agrees that the technical question was answered correctly by me. Page 2674 G – 2678 B: We discuss the third question of the technical test, about the Excel question. I bring up that I clearly have skills with Excel, being able to draw a graph. I state that with a one week refresher course, I would have been able to produce the required graph completely. Mr Kalcher then thinks that it could take one or two months, but that this is very individual. I express my surprise about the Excel question, as I had not been advised that it would be there. Then I point him to the vacancy advert that Excel was a desired skill, not an essential one. So once again Mr Kalcher is beating around the bush trying to make my test look much worse than it really was. Page 2683 C – 2687 D: I ask that Stefan Kalcher compares the two CVs, mine and the one from the successful candidate. It is very obvious that my 20 years of experience compares very favourably with the successful candidate who had recently done 60 hours of basic, even beginner's, online courses. Mr Kalcher tries to talk around it. Mr Martinez gets nervous at this point and starts to interrupt. Mr Kalcher started to stumble over his words. The successful candidate had without any possible doubt very little to offer for this job. This contradicts Mr Kalcher's earlier statement that candidates for Business Analyst roles were easy to find. With the successful candidate, Mr Kalcher was scraping the barrel and it took many months to fill the vacancy which had urgency. Nothing of Mr Kalcher's statements adds up. In page 2687 C – 2689 H: It took as well many months for the successful candidate to be selected: three months after I had been turned down for this job. Page 2690 A – 2692 E: A Risk Business Analyst vacancy was discussed, this was the job the successful candidate had and which Mr Kalcher had said he knew it well as he knew what the successful candidate was doing. Now Mr Kalcher states that he does not know the job, which completely contradicts his earlier statement. Mr Kalcher evades to answer my question if one day I could have gotten the Business Analyst job after self-study. Page 2695 F – G: Mr Martinez re-examines Stefan Kalcher and the Chairman asked Mr Kalcher how many right answers the successful candidate had on the test, which Mr Kalcher could not remember. In Mr Kalcher's written witness statement he said that the successful candidate never did the test. This is an inconsistency with his earlier statement that all candidates have to do the test.
